Terms of Use

These are the Terms of Use (“Terms”) under which all job seekers, employers, recruiters, companies, agencies or other users (“You”) may use our website and the services we provide. 

These Terms constitute a binding agreement between You and Modecover, UG (haftungsbeschrรคnkt) and are deemed accepted by You each time that You use or access our website/ platform/app.

1. Terms Applicable to Employers.

When You register on our website You will be asked to register/login as a company/employer/recruiter with your company name, names, email address, password to create your employer profile account.

Employers are solely responsible for their postings on our platform. 

We reserve the right to remove any job ad or content from our website that does not comply with the above Terms.

As an Employer/Agency/Recruiter you understand and acknowledge that if you delete your employer account or if your employer account is terminated by our administrators, all your account information on our platform, including saved personal information, resumes, documents, files, job listings, offers, network contacts, and email mailing lists, will be marked as deleted and will or may be later be deleted from our servers. Information on our databases may continue to be available for some period of time because of delays in propagating such deletion through our web servers.

We reserve the right to block or delete Your account and all of Your Information after a significant duration of inactivity or if we deem the information provided is incomplete, inaccurate or violates our terms of use or privacy policy.

2. Terms applicable to Job Seekers or candidates and community members.

When You register on our website You will be asked to register/login as a job seeker/applicant/candidate/member with your names, email address, password to create your job seeker profile account.

We reserve the right to block or delete Your account and all of Your Information after a significant duration of inactivity or if we deem the information provided is incomplete, inaccurate or violates our terms of use or privacy policy.

3. Contract between the employer and the applicant/Job seeker

You can apply for job offers directly via our platform messaging recruiters/employers/companies directly by entering your contact details and uploading your documents. Your application will be sent directly to their email address of the company/recruiter that posted the job ad.

4. Costs for the applicants

For job applicants or applicants, using our platform and our services is free of charge. 

5. Costs for recruiters, companies, agencies or partners

Employers, recruiters, agencies or companies, are able to post job offers for free to a certain limit. We also offer subscription packages or one-time payment for posting multiple jobs, promoting job offers or unlocking candidate profiles.

6. Payment on our website

We work with various payment service providers such as Paypal, Visa, MasterCard, giro as well as accept direct bank payments.

7. User Content and Submissions.

We reserve the right to refuse to post, display or transmit any User Content that violates our terms and conditions.

We do not represent or guarantee the truthfulness, accuracy, or reliability of User Content, derivative works from User Content, or any other communications posted by Users nor do we endorse any opinions expressed by Users. You acknowledge that any reliance on material posted by other Users will be at Your own risk.

8. All our Users agree to not:

(a) transmit, post, distribute, store or destroy material,  including but not limited to laws or regulations governing the collection, processing, or transfer of personal information, or in breach of our privacy policy;

(b) take any action that imposes an unreasonable or disproportionately large load on any websites  infrastructure; for example use any data mining, robots or similar data gathering or extraction methods;

(e) violate or attempt to violate the security of our platform including attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;

(j) post any content or material that promotes or endorses false or misleading information or illegal activities, or endorses or provides instructional information about illegal activities or other activities prohibited by these Terms, such as making or buying illegal weapons, violating someone’s privacy, providing or creating computer viruses or pirating media;

(k) post any resume or Profile or apply for any job on behalf of another party;

(l) defer any contact from an employer to any agent, agency, or other third party;

(p) post or submit incomplete, false or inaccurate biographical information or information which is not Your own on our site

(r) solicit passwords or personally identifiable information from other Users;

(t) harass, incite harassment or advocate harassment of any group, company, or individual;

(u) send unsolicited mail or email, make unsolicited phone calls or send unsolicited texts, tweets or faxes promoting and/or advertising products or services to any User, or contact any users that have specifically requested not to be contacted by You;

(v) attempt to interfere with service to any User, host or network, including, without limitation, via means of submitting a virus,, overloading, “flooding”, “spamming”, “mailbombing” or “crashing”;

(w) promote or endorse an illegal or unauthorised copy of another person’s copyrighted work such as softwares, videos, photographs, arts, pirated music or other media files;

(x) use our platform or services for any unlawful purpose or any illegal activity, or post or submit any content, resume, or job ad that is defamatory, libelous, implicitly or explicitly offensive, vulgar, obscene, threatening, abusive, hateful, racist, discriminatory or include any links to pornographic, indecent or sexually explicit material of any kind.

Violations of system or network security may result to deletion of content, a ban on using our platform or services or a civil and/or criminal liability passed on to you..We will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations.

9. Liability

Our website acts as, among other things, a platform for employers to post job opportunities and search for and evaluate job seekers or candidates and for  job seekers to post their resumes and Profiles and search for and evaluate job opportunities. 

To the extent permitted by law, in no event shall our company be liable for the copyright infringements resulting from content generated by users, deletion, loss, or unauthorised modification of any User Content.

10. Links to Other Sites.

Our website may contain links to third party Web sites also provided or posted  by our users. We are not responsible for the content of linked third-party sites and do not make any representations regarding the content or accuracy of materials on such third party Websites. If You decide to access linked third-party Websites, You agree to do so at Your own risk.

11. Indemnity.

You agree to defend, indemnify, and hold our company harmless including its employees, agents, affiliates, partners from and against any claims, actions or demands.

12. Final provisions

The German law applies. Subsequent amendments and additions to the contract and collateral agreements must be made in writing. This also applies to the cancellation of this written form clause.

Should one or more provisions of these General Terms and Conditions be legally ineffective in whole or in part, this shall not result in the ineffectiveness of the remaining provisions. The ineffective provision shall be replaced by the relevant statutory provision.
